TERMS AND CONDITIONS FOR CONTEST PARTICIPATION 

Picture This - Visuals Stories of Phuket Photography Contest

** If the number of entries does not reach 30 entries by the final day of the contest.
Sadly we will consider it financially unsustainable and unsuccessful, leading us to cancel the contest.**

Here's how to participate:

1.) Please submit ONLY ONE IMAGE that has been  taken within the province of Phuket, Thailand!

2.) Read and agree to these terms and conditions!

The requirements for participation will be as follows:

• Global citizens aged 18 years and over may participate.

• Only users with a valid Instagram or Facebook accounts may participate.

• Follow @phuket_photographytours on Instagram or @Phuket Photography Tours on Facebook.

• Share your entry we post on your IG or FB story and tag @phuket_photographytours

• Follow @jameshutleykwphuket on Instagram or Facebook.

• Participants cannot enter if they are one of the six judges or employed or related to any member of Phuket Photography Tours or Keller Williams Phuket.

1. CONTEST ORGANIZER

The company [Phuket Photography Tours Co. Ltd.] located at 88/8 Moo 2, Pa Klok, Thalang District, Phuket 83110 and identified by number 0835565018474 has organized this contest (hereinafter, “the Promotion”) which will take place on the internet, global residents in accordance with the provisions in the participation requirements section.
 

The purpose of this contest is to create brand awareness for Phuket Photography Tours Co. Ltd., Keller Williams Phuket - REAL ESTATE AGENCY and our"Local Partners" - Trusted Businesses Recommendations! And raise funds to help our amazing community partners in Phuket at our silent auction and appreciation event to celebrate the talented participants and businesses throughout Phuket!
 

2. START DATE AND END DATE

The Contest will start on September1st, 2023 at 12:00 am Bangkok time and end on October 27th, 2023 11:59 pm Bangkok time. Judging will commence from October 28th - November 9th and the winners will be announced on November 10th!

**Depending on the number of participants we hope to close the contest with an event to celebrate the winners, participants and Local Partners around Phuket in November. Details coming soon! 
 

4. CONTEST CONDITIONS AND PRIZES

All winners submissions will be featured on www.phuketphotographytours.com website with links to their social media account to help promote their work.
 

**Our grand prize winner will have the experience of a lifetime with the Phuket Photography Tours team in or around Phuket! The lucky winner will embark on a full day trip, carefully planned with the winner and our team, for up to six guests. The experience will include guidance from our professional photography instructor Kolin and our Thai tour guide Khun Kee, transportation, meal, and non-alcoholic drinks, valued up to 40,000 THB ($1100 USD)! This photography experience will showcase some of the most stunning photography locations in Phuket, with expert guidance on how to capture the beauty of the surroundings using your camera or smartphone. Please note that the prize cannot be exchanged for cash or any other prize, nor can it be modified in any way.

Our second and third place will receive amazing prizes from our Local Partners - Trusted Businesses recommendations which include hotels, restaurants, and businesses throughout Phuket.

**The winners of the prizes must discuss booking their prize with the local business as there might be times of year that they might not be able to offer ex. peak high season Christmas and New Years. We will put you in touch with the manager or business owner to redeem your prize!

Running of the contest, as well as awarding of the prize, are subject to current tax regulations. 

**Flights, accommodations and VISA costs in Thailand are not included in the prize**
 

5. BASIC SUBMISSIONS GUIDELINES FOR PHOTOGRAPHS

1. The contest is open for online submissions only.
2. Submissions will not be accepted once the deadline lapses.
3. Photos submitted must be at least 640 pixels on the shorter side, and no more than 2000 pixels on the longer side. Images should be no larger than 6MB. Photos must be in JPEG format.
4. You may only submit one image to this contest.
5. You are required to provide a unique title & description for your image.
6. All submitted photos must contain the original EXIF metadata information. However there must be no border(s), logo(s), copyright marks, identifying marks, or any other visible references and/or marks on the image.
7. Basic editing, including colour enhancement, the use of filters, and cropping of the Photo(s) is acceptable, provided any such editing does not affect the authenticity and/or genuineness of the Photo(s).
8. Advanced editing used to create illusions, deceptions and/or manipulations, and the adding and removing of significant elements within the frame is prohibited.
9. Every image uploaded is subject to a moderation process before it becomes visible on the contest page. Phuket Photography Tours reserves the right to assess and disregard any submitted photo at our its discretion.
10. Photos that portray or otherwise include inappropriate and/or offensive content, including provocative nudity, violence, human rights and/or environmental violation, and/or any other contents deemed to be contrary to the law, religious, cultural & moral traditions and practices of Thailand, are strictly prohibited and will be immediately discarded.

6. WHAT THE JUDGES WILL BE LOOKING FOR IN YOUR SUBMISSION

1. Lighting: Judges should assess the use of lighting in the photograph. Is the lighting well-balanced, creating a pleasing atmosphere and highlighting important elements? The skillful manipulation of light can greatly enhance the overall quality of a photograph.
    

2. Storytelling: Judges should look for photographs that effectively convey a story or narrative. Does the image capture a moment or tell a compelling story? The ability of a photograph to communicate a story is crucial in capturing the viewer's attention.
    

3. Technical Quality: Judges should evaluate the technical aspects of the photograph, such as focus, exposure, sharpness, and overall image quality. A technically sound photograph demonstrates the photographer's skill and attention to detail.
    

4. Creativity: Judges should consider the level of creativity displayed in the photograph. Does the image show a unique perspective or innovative approach? The ability to think outside the box and present a fresh and original concept is a valuable quality in a photograph.
    

5. Composition: Judges should assess the composition of the photograph. Is the image well-organized and visually pleasing? Consideration should be given to factors such as the rule of thirds, leading lines, balance, and symmetry.
    

6. Points of Interest: Judges should look for elements in the photograph that capture the viewer's attention and create visual interest. Are there focal points or interesting details that draw the viewer's eye and add depth to the image?
    

7. Use of Color: Judges should evaluate the use of colour in the photograph. Is the colour palette harmonious and appropriate for the subject? The skillful use of colour can greatly enhance the mood and impact of a photograph.
    

7. THE JUDGING

1. Phuket Photography Tours will appoint a panel of six judges for this contest. This will comprise of members from the Phuket photography community.

2. The judging panel shall assess and determine the winning Photos. The results and the winners will be announced on this website and our social media channels.

3. Phuket Photography Tours’s judging panel will be final and binding on all Participants in respect to all matters relating to the Contest.

4. Phuket Photography Tours reserves the right to call for original JPEG or RAW files with unchanged EXIF for the purpose of authentication. An image maybe disregarded if this information cannot be provided.
 

8. INTELLECTUAL PROPERTY RIGHTS

1. Submitted photos must be original, created and/or taken by the contestant. It must not contain any materials owned or controlled by a third party for which you have not obtained a license, must not infringe the copyright, trademark, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity.

2. Phuket Photography Tours and it's partners respects photographers’ copyrights and copyrights shall remain vested with the creator of the image. Upon making the submission, you grant Phuket Photography Tours and it's partners, worldwide, non-exclusive, royalty free, sub-licensable right and license to use, publish, reproduce, display, perform, adapt, create derivative works, distribute, have distributed, print, in whole or in part, in any form, in all media forms now or hereafter known, to promote the contest, image, the photographer or for editorial or educative use.

3. The Photographer will be credited wherever the image is used.

9. LIABILITY

1. You hereby hold harmless, release, indemnify and discharge Phuket Photography Tours and it's partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers and representatives from all liability, claims, judgments, demands, controversies, agreements, damages, actions and causes of action whatsoever, arising out of or related in any way to the contest or the conduct of the contest and the acceptance and use, misuse, or possession of any prize awarded, whether in law or in equity, no matter what the cause or nature, and You further waive any claims that You may state or assert against Phuket Photography Tours and it's partners in association with the contest or any of its associated activities, or in any way related to or resulting from the contest even if such injury or claims results from or is caused by the negligence or gross negligence of Phuket Photography Tours and it's partners, in whole or in part, due to human error or otherwise. You further agree to indemnify and hold harmless Phuket Photography Tours and it's partners from any claim arising out of your participation in the contest including, without limitation, all claims brought or asserted by any third party as a result of any injury or loss that You or they may sustain in any way associated with your participation in the contest.

2. Under no circumstance will Phuket Photography Tours and it's partners be liable for any:
a) lost, late, misdirected, stolen, illegible or incomplete Submissions

b) error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, submitted Photo(s);

c) problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing;

d) incorrect or inaccurate information, caused by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of the Photos and/or the Submissions; and/or

e) injury or damage to any Participant or to any computer related to, resulting from or in connection with the Contest.

3. If, for any reason, the contest is not capable of being conducted as anticipated, due to computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Phuket Photography Tours and it's partners, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the contest, Phuket Photography Tours and it's partners reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest as deemed appropriate, disqualify any Participant, and/or select winners from all eligible Photos submitted prior to the termination, cancellation, modification or suspension. Phuket Photography Tours and it's partners reserves the right to correct any typographical, printing, computer programming or operating errors at any time.
 

10. DISQUALIFICATIONS AND PENALTIES

If it becomes evident that any of the Participants have not met the requirements of these Terms and Conditions, or that the data provided for participation is not valid, the participation is considered null and void and the Participant will automatically be excluded from the Promotion, losing all rights to the prize(s) on offer in the Promotion.

 

11. PUBLICATION OF COMMENTS OR OPINIONS

No comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory, or that could violate the rights of third parties, will be allowed. Nor will comments be permitted against any individual that are an infringement of personal honour, personal and family privacy, or personal image rights. We will not be responsible for any damages caused by comments made by Promotion Participants, or that may at any time offend the sensitivities of other Participants.

12. PROTECTION OF PERSONAL DATA 

In accordance with the provisions of the General Data Protection Regulation, by accepting these Terms and Conditions, each Participant consents to have their personal data included in a file, owned by the Promotion Organizer, for the purpose of managing the sweepstakes, disseminating and publicizing the results, and administering the awarding of the prize.
 

We inform you that you may exercise your rights of access, rectification, deletion, opposition, limitation of processing, portability, and right to be forgotten, as well as your right to not be the subject of automated individual decisions, by sending an email to info@phuketphotographytours.com attaching a copy of your ID document.

 

13. CHANGES AND ACCEPTANCE
As the contest organizers, we hold the right to modify the rules, entry requirements, prizes, or schedule of any contest. Additionally, we have the authority to cancel any contest. Although such measures are rarely taken, if we do need to alter the rules or cancel the contest, we assure you that it will be for a valid reason.

By participating in the contest, the Participant is, by implication, fully accepting the conditions of these Terms and Conditions.

 

14. APPLICABLE LEGISLATION AND JURISDICTION

These Terms and Conditions shall be governed in accordance with the laws of Thailand. The Courts and Tribunals of the city of residence of the Participants will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these Terms and Conditions.
